General Terms of Use — Kiddly

1. Purpose
Kiddly is a mobile application for family organization (calendar, tasks, meals, groceries, equipment inventory), children's health tracking, creation of printed photo albums and lending/donating items between families ("Lending & Donations"). These terms govern access to and use of the application and the thekiddly.app website. By creating an account, you accept them; the accepted version and its date are recorded.
2. Access and account
- Kiddly is reserved for adults (18 and over). Children are never users: they are described by their parents.
- An account is personal; a family groups several parent accounts around the same children. The first parent creates the family and invites the others with a code. Each parent is responsible for the information they enter, including information about their children or other people (co-parent, calendar contacts): they make sure they are entitled to share it and, where applicable, to inform the people concerned. Any parent who is a member of a family can view and edit the data of the children of that family; managing members and roles is reserved for the administrator and owner roles.
- You undertake to provide accurate information and to protect your credentials. You inform Kiddly without delay of any unauthorized use.
- Kiddly may suspend or close an account in the event of a breach of these terms, after informing the user except in urgent cases.
3. Free service and paid services
- The application is free. Some features may become paid in the future; they will be clearly identified and never imposed retroactively.
- Ordering printed albums is paid: the price including VAT, the delivery costs and the lead times are displayed before payment. Payment is processed by Stripe; printing and delivery by our provider Gelato.
- Right of withdrawal: albums are goods made according to your specifications and personalized; in accordance with Article VI.53, 3° of the Belgian Code of Economic Law, the right of withdrawal does not apply once production has started. You are informed of this and accept it before payment. In the event of a printing or delivery defect, contact support@thekiddly.app: we reprint or refund.
4. Your content
- You remain the owner of the content you enter or upload (texts, photos). You grant Kiddly a limited, non-exclusive license for the sole purpose of providing the service (storage, display to the members of your family, printing of the albums you order, publication of the listings you choose to publish).
- You warrant that you hold the necessary rights to the photos you share, in particular the image rights of the people depicted.
- Photos of children: Lending & Donations listings are visible to all signed-in users. Do not publish any photo of a child in a listing; only photos of the item are expected. Kiddly may remove any listing that does not comply with this rule.
- The following are prohibited: unlawful, misleading or discriminatory content, third-party data without authorization, any commercial use of the application.
5. Lending & Donations between families
- The module connects families who wish to lend or donate baby gear free of charge. No financial consideration is allowed, in any form.
- Exchanges are based on good faith. Kiddly is neither a party, nor a commercial intermediary, nor an insurer, nor an arbitrator: Kiddly does not check the items, does not guarantee their condition, their safety or their compliance, and does not guarantee the successful completion of the exchange. You are solely responsible for checking that an item is suitable and safe for your child (in particular car seats, beds, baby gear subject to standards).
- Good-faith contract: each exchange gives rise to a time-stamped summary (item, families, dates, handover and return signatures). This document formalizes an agreement between private individuals; it does not bind Kiddly.
- Visible data: your listings display your photos, your postal code and your municipality. When a request is accepted, your family name, your first name, your email and your phone number are shared with the other family — and vice versa — to arrange the handover; they remain visible until the end of the ongoing exchange. A phone number is required to publish or request an item. These rules are detailed in the module's consent and the privacy policy.
- Reports and moderation: you can report a listing or an exchange. The Kiddly team may send a reminder of the rules, hide a listing or suspend a family's access to the module. The family concerned is informed in the application, as well as of the lifting of the measure. The author of a report is never revealed. Any measure may be contested at support@thekiddly.app.
- Blocking: you can block a family; your respective listings become invisible to each other. An exchange already in progress continues until its completion.
- Account deletion during an ongoing exchange: the deletion is carried out after the return of the item; the application tells you so at the time of the request.
6. Health: information, not medical advice
The health features (vaccines, milestones, growth, appointments, pregnancy) are tracking and reminder tools. They do not constitute medical advice and do not replace consulting a professional. The vaccination schedules displayed reflect the Belgian public recommendations for information purposes; if in doubt, consult your doctor or ONE/Kind & Gezin.
7. Availability and evolution of the service
Kiddly is provided "as is". We aim for high availability without guaranteeing it; interruptions for maintenance or incidents are possible. Features may evolve. You can export your data at any time (see §9).
8. Liability
To the extent permitted by law, Krapul SRL is not liable for indirect damages, for data loss due to non-compliant use, nor for disputes between families arising from a loan or a donation. Nothing in these terms excludes Krapul SRL's liability in the event of fraud or gross negligence, nor the rights the law guarantees you as a consumer.
9. Personal data
The processing of your data is described in the privacy policy, which forms part of these terms. You can export your data and delete your account from the application (Profile → Privacy). Contact: privacy@thekiddly.app.
10. Intellectual property
The application, its brand, its design and its code are the property of Krapul SRL. The equipment catalog and the editorial content are provided for your personal use.
11. Changes to the terms
Krapul SRL may amend these terms. Any substantial change is notified in the application with a reasonable notice period; continued use after this period constitutes acceptance, and the application asks you to accept the terms again when the version changes. The version history is available on thekiddly.app.
12. Termination
You can delete your account at any time from the application. Krapul SRL may terminate access in the event of a serious breach, after notification, without prejudice to legal retention obligations (§9 and privacy policy).
13. Applicable law and disputes
These terms are governed by Belgian law. In the event of a dispute, we invite you to contact us first at legal@thekiddly.app. You may turn to the Consumer Mediation Service (Boulevard du Roi Albert II 8, 1000 Brussels — mediationconsommateur.be). Failing an amicable agreement, any dispute falls under the competent courts in accordance with the applicable mandatory rules, in particular those protecting consumers.
